Terms of service

These terms are an agreement between you and Fotessa ("we", "us"), who run Fotessa at fotessa.com. By creating a site you agree to them. If something here is unclear, email hello@fotessa.com.

What Fotessa is

Fotessa hosts a portfolio website and private client galleries for photographers. You upload photographs, choose how your site looks, and share galleries with your clients so they can view, choose and download photos.

Your account

• You must be at least 18 and give a real email address. You're responsible for keeping your password safe and for everything done with your account.
• One account has one site. Your site's address (yourname.fotessa.com) must not mislead people about who you are.

Your photographs and content

• You own your work. We claim no rights over it. You give us permission to store, copy, resize and show it only as needed to run your site and galleries, and to keep it in backups.
• You must have the right to upload everything you upload, including permission from the people in your photographs where the law requires it.
• You must not use Fotessa for anything illegal, for sexual content involving anyone under 18, for content that harasses or threatens people, for malware or phishing, or to store files that aren't part of your photography business.
• We may remove content or suspend a site that breaks these rules. Where we can, we'll tell you first and give you a chance to fix it.

Your clients' information

When your clients use your galleries or your contact page, they give their name and email address, and their favourites, comments and downloads are recorded for you. For that information you are the controller and we are your processor, under UK and EU data protection law. That means:

• We only use it to run your site and galleries, on your instructions (which are these terms and the settings you choose).
• Everyone who works on Fotessa is bound to keep it confidential, and we protect it with the security measures described in our privacy policy.
• We use the subprocessors listed in our privacy policy, and will tell you by email before adding or replacing one, so you can object.
• We will help you respond to your clients' requests to see or delete their information, and tell you without delay if we discover a breach affecting it.
• When your site is deleted, we delete this information as described in our privacy policy.

You're responsible for telling your clients how you use their information, for example in your own privacy notice.

Plans and payment

• The Free plan costs nothing and includes 1 GB of storage and a small "Made with Fotessa" line in your site's footer.
• Paid plans (Starter at £8 a month or £80 a year; Pro at £18 a month or £180 a year) are billed in advance and renew automatically until you cancel. Prices include any VAT or sales tax that applies. Studio is arranged with us directly.
• Paid plans are sold through Stripe, which acts as the reseller and merchant of record: Stripe takes your payment, charges and pays any tax, and issues your receipts and invoices, under its own terms, which you'll see at checkout.
• You can cancel at any time from the Billing page. Your plan continues until the end of the period you've paid for, then your site moves to the Free plan. We don't refund part-used periods, except where the law requires it.
• If a payment fails, Stripe will try again for a while. If it still can't be taken, your site moves to the Free plan.
• Moving to a smaller plan never deletes anything. If you're over the new plan's storage, everything stays online, but you can't upload more until you're back under it. Your own domain keeps working, and galleries set to full-resolution downloads offer web-size files instead.
• We may change prices. We'll email you at least 30 days before a change affects you, and it takes effect at your next renewal, so you can cancel first if you prefer.

Availability and backups

We work hard to keep Fotessa running and back it up every night, but we can't promise it will never be unavailable or that nothing will ever be lost. Keep your own copies of your original photographs. You can download everything at any time from Settings.

Ending

• You can delete your site at any time from Settings. It goes offline immediately and is permanently deleted 14 days later. A paid subscription is cancelled when you delete your site.
• We may close an account that seriously or repeatedly breaks these terms, or the Free plan of an account that has been unused for over two years, after emailing you at least 30 days before.
• If we ever stop running Fotessa, we'll give you at least 60 days' notice to download your work.

Liability

Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud. Otherwise, we're not liable for loss of profits, business or goodwill, or for indirect losses, and our total liability to you in any 12 months is limited to the amount you paid us in that time, or £100 if that's more. If you use Fotessa as a consumer, your legal rights as a consumer are not affected.

Changes to these terms

We may update these terms. If a change matters, we'll email you at least 30 days before it takes effect. Continuing to use Fotessa after that means you accept the new terms.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, unless you're a consumer living elsewhere in the UK, in which case you can also use your local courts.
